Terms and Conditions Introduction

  1. The VolvoLife Owners Program (“Program”) is made available by Volvo to Eligible Owners under these Terms and Conditions. Information on how to participate in this Program and the various offers and rewards offered in this Program form part of these Terms and Conditions. Registration for the Program and continued participation in the Program is deemed acceptance of these Terms and Conditions.
  2. The Promoter is Volvo Car Australia Pty Ltd of 65 Epping Road, North Ryde, NSW 2113 (“Volvo”).
  3. The laws of Australia apply to this Program to the exclusion of any other law. These Terms and Conditions shall be governed by and construed in accordance with the laws in force in the various States and Territories of Australia. Participants submit to the exclusive jurisdiction of the courts of Australia.
  4. Volvo’s decisions in relation to all matters arising under this Program are final and binding. No correspondence will be entered into.

ELIGIBILITY AND REGISTRATION

  1. Registration for the Program is available to Australian residents aged 18 years or over who either:
    (a) have purchased a Volvo car from an authorised Volvo dealership in Australia on or after 01/01/2005 or
    (b) personally receive an invitation from Volvo to register for the Program
  2. To register, Eligible Owners must access the Program website located at www.volvolife.com.au (“Website”), follow the prompts to the online registration form, nominate a unique username and a password, and fully complete and submit the online registration form including all mandatory information.
  3. Eligible Owners whose registration is accepted by Volvo (“Member”) will be sent an email to the address nominated on the registration form, confirming their username and password login details.
  4. Each Eligible Owner may only register as a Member once.
  5. Members may login to the Website by entering their username and password to access their registered profile details and information about their offer/reward redemption history.
  6. Members must keep their password secret, and must not disclose their password to any other person or record their password in such a way that another person could find and use it. Each Member will be responsible for any use of their login details.

OFFERS AND REWARDS

  1. From time to time, Volvo may make various offers and rewards available to Members.
  2. Volvo may advertise each offer or reward to Members via the Website and/or by contacting individual Members (including via email).
  3. Volvo may make particular offers or rewards available only to selected Members, in its absolute discretion.
  4. To redeem or claim an offer or reward, Members must login to the Website using their username and password, then follow the prompts and instructions relating to the particular offer or reward.
  5. Offers and rewards will only be available for a limited time and will be subject to any specific expiry or closing date as advertised.
  6. Each offer or reward may be subject to a limit on the number of times each eligible Member may claim or redeem it, as advertised.
  7. Offers and rewards will be subject to any special or additional terms, conditions, restrictions and limitations applicable to each specific offer and reward (“Specific Conditions”), including any terms, conditions, restrictions and limitations advertised in relation to the offer or reward. Specific Conditions are to be read in conjunction with these Terms and Conditions, and both these Terms and Conditions and any relevant Specific Conditions will apply to claiming and redeeming any offer or reward. To the extent of an inconsistency between Specific Conditions and these Terms and Conditions, the Specific Conditions will prevail.
  8. Chance plays no part in determining the availability of offers and rewards to Members.

GENERAL

  1. Volvo reserves the right, at any time:
    (a) to verify the eligibility of Eligible Owners and Members, including but not limited to identity, age, place of residence and vehicle ownership status;
    (b) to verify the validity of Member registrations;
    (c) to verify the validity of claims and redemptions for various offers and rewards;
    (d) to disqualify any person who acts otherwise than in accordance with these Terms and Conditions or and Specific Conditions.
  2. Failure by Volvo to enforce any of its rights at any stage does not constitute a waiver of those rights.
  3. Member registrations and offer/reward claims and redemptions which are incomplete, indecipherable or illegible will be deemed invalid.
  4. If there is a dispute as to the identity of an Eligible Owner or Member, Volvo reserves the right, in its sole discretion, to determine the identity of that person.
  5. If, for any reason, a Member does not take or redeem an offer or reward (or an element of an offer or reward) at the time stipulated by Volvo, then the offer or reward (or that element of the offer or reward) will be deemed to be forfeited by the Member.
  6. If any offer or reward (or part of any offer or reward) becomes unavailable, Volvo, in its absolute discretion, reserves the right to substitute the offer or reward (or that part of the offer or reward) with an alternative offer or reward to the equal value and/or specification.
  7. Offers and rewards (and any unused portion of any offer or reward), are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  8. Any cost associated with accessing the Website is the responsibility of the Eligible Owner or Member in each case, and is dependent on the Internet service provider used.
  9. The use of any automated software or any other mechanical or electronic means that allows a person to automatically register or submit a claim or redemption repeatedly is prohibited and may, at Volvo’s absolute discretion, render all registrations, claims and redemptions submitted by that person invalid.

LIABILITY

  1. Except for any liability that cannot be excluded by law, Volvo (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Program, including, but not limited to, where arising out of the following:
    (a) any technical difficulties or equipment malfunction (whether or not under Volvo’s control);
    (b) any theft, unauthorised access or third party interference;
    (c) any Member registration or claim/redemption for an offer or reward that is late, lost, altered, damaged or misdirected (whether or not after receipt by Volvo) due to any reason beyond Volvo’s reasonable control;
    (d) any variation in the value of an offer or reward;
    (e) any tax liability incurred by a Member; or
    (f) use of any offer or reward.
  2. Unless otherwise specified, Volvo is not the manufacturer or distributor of the various offers and rewards available in this Program, and does not provide any warranties or guarantees in relation to the offers and rewards.

PRIVACY

  1. Volvo collects personal information in order to administer the Program and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, prize suppliers and, as required, to Australian regulatory authorities. Participation in this Program is conditional on providing this information. Volvo may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning Members. Members should direct any request to access, update or correct information to Volvo at its address set out above. All Member registrations and claims/redemptions for offers and rewards become the property of Volvo.

TERMINATION AND SUSPENSION

  1. If a Member ceases to be eligible for the Program for any reason, including but not limited to by reason of selling their Volvo car or becoming an employee (or immediate family member of an employee) of Volvo, Volvo may, in its absolute discretion, terminate that Member’s membership, and that person will no longer be eligible to claim or redeem any offers or rewards.
  2. If this Program is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Volvo, Volvo reserves the right, in its sole discretion, to the fullest extent permitted by law:
    (a) to disqualify any person; or
    (b) to modify, suspend, terminate or cancel the Program.
  3. In the event of war, terrorism, state of emergency or disaster, Volvo reserves the right to cancel, terminate, modify or suspend the Program.
  4. Volvo may, in its absolute discretion, at any time:
    (a) change, amend or vary these Terms and Conditions;
    (b) change, amend, vary, withdraw or cancel any offer or reward, the value of any offer or reward or any Specific Conditions relating to an offer or reward;
    (c) exclude any person(s) from participating in the Program;
    (d) cancel any person(s) membership in the Program; without prior notice to Members.
  5. Any changes to these Terms and Conditions will be published on the Website and will be effective immediately upon publication on the Website, unless otherwise specified.
  6. Volvo may, in its absolute discretion, cancel or withdraw the Program in its entirety, at any time, by giving 30 days notice on the Website.
